Texas law regarding unwanted sexually explicit images
In Texas, it is a crime to send unwanted sexual images. Read the law below:
Sec. 21.19. UNLAWFUL ELECTRONIC TRANSMISSION OF SEXUALLY EXPLICIT VISUAL MATERIAL
(a) In this section, “intimate parts,” “sexual conduct,” and “visual material” have the meanings assigned by Section 21.16.
(b) A person commits an offense if the person knowingly transmits by electronic means visual material that:
(1) depicts:
(A) any person engaging in sexual conduct or with the person’s intimate parts exposed; or
(B) covered genitals of a male person that are in a discernibly turgid state; and
(2) is not sent at the request of or with the express consent of the recipient.
(c) An offense under this section is a Class C misdemeanor.
(d) If conduct that constitutes an offense under this section also constitutes an offense under any other law, the actor may be prosecuted under this section or the other law.

What qualifies as a sexually explicit photo?
Here are some examples of a sexually explicit photo:
- a person engaged in a sexual act
- a picture of a person’s exposed private or intimate parts
- an erect penis, even if it is clothed
Under Penal Code 21.19 it a Class C misdemeanor to send unwanted sexual material.
Is sexting illegal in Texas?
No, sexting is not illegal in Texas as long as the messages and photos sent and received are between consenting adults. However, if one or more participants do not consent or are a minor, it is a crime.
Can minors consent to send or receive sexually explicit photos?
No, minors cannot consent. Sending, receiving, or possessing any sexually explicit photos of a minor is a federal offense. It is a crime in Texas to send any naked image to someone under 18 years old regardless of consent. Even if a minor sends a nude photo to another minor it is still a Class C misdemeanor rather than a felony.
